Is there a fee for a consultation with an attorney at Bailey & Galyen?

There is no charge for an initial attorney consultation. You are under no obligation to use our firm to represent you.

How will l pay attorney fees?

Our attorneys represent personal injury accident clients on a contingent fee basis, which means a percentage of the recovery is used to cover the fee for your personal injury or wrongful death claim.

If we’re unable to recover any money for my claim, will I owe you a fee?

No. When our firm decides to take a case, we do expect to recover monetary damages and do so in most cases.

What is my personal injury case worth?

Every personal injury case involves a different set of circumstances. What your case is worth will depend on the nature of the injuries sustained, determination of liability, and the ability of responsible parties to pay damages. At Bailey & Galyen, our personal injury attorneys will explore every source for recovery of damages and do our utmost to obtain the maximum settlement possible within the law.

How long will it take to settle my case?

While our attorneys will make every effort to settle your case as quickly as possible, the time frame will vary according to the nature of ther injury and the insurance companies involved and liable party representatives. Settling personal injury cases may be accomplished by dealing directly with insurance companies, through arbitration, mediation or your case may be presented to a jury, if the case cannot be settled out of court.

How will I pay medical bills while my case is being settled?

When your attorney reviews your case, he will review the variety of possible sources for payment of medical bills, arising from your serious injury. Each case is different. However, any one or combination of the following may be a source for your medical bill payment.

  • Health insurance from your employer.
  • Health insurance for which you have personally paid.
  • Health insurance coverage through a spouse’s or through your parent’s policy, if you are a dependent.
  • Medical payments insurance from your auto insurance policy called Personal Injury Protection or PIP insurance, which provides coverage, if you are involved in an accident, while driving your car.
  • Medical insurance coverage from the driver of the motor vehicle, if you were a passenger in his insured vehicle.
  • Workers’ compensation insurance if your injury occurred in the workplace or as a result of your employment.
  • Personal funds
  • Liability insurance coverage for the company or the person(s) responsible for your injuries. Payment of coverage through liability insurance is most commonly paid at the time of your case settlement.

What if there is no insurance coverage for my injury and I am unable to pay my medical bills when they are presented?

When you are injured and have no medical insurance or financial means to pay your medical bills when they occur, medical providers will often wait for payment. However, as soon as you have an appointment to discuss your care and medical treatment, it is important to let medical providers know your medical bills will be paid when your case is finally resolved through a settlement or verdict in court.

If I have been injured due to the negligence of another, how long do I have to file a lawsuit?

It is important to contact a lawyer as soon as you are injured or discover an injury. In the U. S., each state set time limits for lawsuits known as ''Statutes of Limitations.'' The amount of time you have to file a lawsuit will depend on your state’s Statutes and will vary according to the type of claim being presented, such as personal injury, product liability or medical malpractice. In some states, the time limit to file a lawsuit for a tort claim may be as short as one year. If you miss the time limit deadline for filing your case, your personal injury claim can be dismissed.
